Land, Property & Trust Disputes
Disputes concerning title disputes, trusts and beneficial ownership, use of land, fraud, statutory issues under the National Land Code, and recovery of land.
Acted for a charitable institution in a land dispute involving novel questions on the ownership of land occupied by a government-aided school, including issues concerning legal personality under the Education Act 1996, equitable interests in land, expectation of title and indefeasibility of title under the National Land Code.
Acted as junior counsel in consolidated Federal Court appeals arising from allegations of fraud, breach of trust and forged documents in relation to land and share sale transactions, involving questions on the burden of proof in forgery claims, expert handwriting evidence and the evidential weight of attesting witnesses.
Acted as junior counsel in proceedings before the Court of Appeal and Federal Court concerning whether a school board constituted under the Education Act 1996 possesses the legal capacity to sue and be sued, involving issues of statutory interpretation, representative actions and the administration of trust property held for a school.
Acted as junior counsel for the appellant in Court of Appeal proceedings involving a long-running dispute over valuable estate land, raising issues on the construction of a will, codicil and trust deed, the distinction between charitable and private trusts, the doctrine of cy-près, and the effect of historical court orders on the administration of trust property
Intellectual Property
The practice encompasses trademark, copyright and related intellectual property disputes, including enforcement strategies, litigation, invalidation and revocation proceedings, passing off claims, and prosecution proceedings before the Intellectual Property Corporation of Malaysia. The firm also advises on cross-border brand protection, anti-counterfeiting measures and strategic enforcement programmes.
Acted against a well-known international fashion brand in High Court proceedings resisting an application to invalidate multiple registered trademarks involving issues of likelihood of confusion, proprietorship, concurrent rights and appeals against decisions of the Registrar of Trademarks.
Acted as junior counsel in High Court and Court of Appeal proceedings involving the invalidation of a registered trademark, raising issues concerning prior proprietorship, likelihood of confusion, passing off and copyright infringement.
Acted in one of the earliest reported decisions under the Trade Marks Act 2019 involving the partial revocation of a registered trademark for non-use, raising issues concerning genuine use and the interpretation of the Trade Marks Act 2019.
Assisted as junior counsel in Court of Appeal and Federal Court patent litigation involving the validity of a registered patent, raising issues concerning prior art, inventive step and the pleading requirements in patent invalidation proceedings.
Acted in proceedings involving allegations of breach of confidence and misuse of confidential information, arising from the unauthorised use of proprietary commercial information.
Advised clients across the consumer goods, food and beverage, hospitality, retail, technology and entertainment and acted in enforcement programmes involving counterfeit goods, cease and desist demands, online takedown notices and coordinated enforcement action by the relevant authorities.
Advised on online brand protection, including the preparation of takedown notices to e-commerce platforms and digital service providers in relation to infringing content and counterfeit goods.
Employment & Industrial Relations
The practice covers wrongful dismissal claims, disciplinary proceedings, retrenchments, workplace investigations, contractual employment disputes and collective bargaining.
Acted for an employee of a statutory body in a High Court claim arising from dismissal following disciplinary proceedings. The matter involved the implied duty of mutual trust and confidence, procedural fairness, natural justice, and the extent to which an employer's disciplinary process complied with contractual obligations where reinstatement under the Industrial Relations Act was unavailable.
Acted in judicial review and appellate proceedings arising from the registration and recognition of a competing trade union. The matter involved the interaction between the Trade Unions Act 1959 and the Industrial Relations Act 1967, raising issues of statutory interpretation, procedural fairness, natural justice, legitimate expectation and the right of an existing trade union to be heard before decisions affecting its representational rights were made.
Acted for a Joint Management Body in defending an Industrial Court claim arising from a restructuring exercise following the outsourcing of property management functions. The matter involved genuine redundancy, performance management, performance improvement measures, and whether the termination was justified following a reorganisation of the employer's operations.
Acted for a hotel employees' union in industrial relations disputes concerning collective employment rights, recognition and the enforcement of statutory protections afforded to union members..
Acted for a private hospital in employment proceedings concerning allegations of employee misconduct, workplace investigations, disciplinary action and the lawfulness of dismissal.
Family & Matrimonial
Family and matrimonial disputes, including divorce proceedings, financial claims, custody and parenting arrangements, and related applications. The practice focuses on resolving family disputes with sensitivity while protecting clients' legal and commercial interests.
Assisted as junior counsel in high-value matrimonial proceedings involving the division of matrimonial assets exceeding RM280 million, including disputes concerning the ownership, acquisition and division of assets acquired before and during the marriage, in proceedings before the Court of Appeal and Federal Court.
Advised on postnuptial settlement agreements, including the structuring and documentation of financial arrangements between spouses.
Acted in divorce and family proceedings, including contested and uncontested petitions, joint petitions, and related applications concerning custody, guardianship, care and control, and access to children.
Commercial Disputes
Commercial disputes involving contractual, banking and financial services, shareholder and corporate disputes, negligence claims, fraud-related claims, asset recovery and other business disputes.
Acted in High Court, Court of Appeal and Federal Court proceedings arising from an investment dispute involving claims in negligence against a financial institution concerning the unauthorised diversion of investment funds, banking duties of care, and liability for pure economic loss.
